All Plans sold by Mike Waller Yacht Design are sold subject to the following conditions:

1. Copyright in all plans and associated matter remains with Michael D. Waller or Mike Waller Yacht Design. Your purchase price gives you the right to use the information on those plans to build one (1) vessel only.

2. Plans are sold on the understanding that one boat only will be built from any given plan set. A royalty equal to the cost of the plans is payable for each subsequent vessel constructed, payable prior to commencement of the vessel. A new set of numbered plans will be issued to the builder for each vessel constructed.

3. Neither Michael D. Waller nor Mike Waller Yacht Design accepts responsibility for any vessel where the builder chooses to vary the vessel from the plan in any significant way without prior written approval from the designer.

4. Liability of Michael D. Waller and Mike Waller Yacht Design is limited to the price paid for the plans.

5. The fee charged for full stock plans includes backup to the extent of advise on the construction of the vessel as per plan unless otherwise specified, but does not include personal supervision, nor additions nor alterations to the plans as designed.

6. Plans may not be re-sold, copied or otherwise disposed to a third part without express written authority from Mike Waller Yacht Design.

7. The designer reserves the right to add to, alter the contents of, or withdraw from sale, any plan at any time.

8. The designer reserves the right to decline any sale at any time.
 

Within Australia

All plans within Australia are delivered by standard postal services, which are safe and reliable. All deliveries to major cities should occur within 1 or 2 days of posting, and even in the most remote places in Australia delivery should only be a few days at most. Delivery cost is included in the plan price.

Countries other than Australia

EXPRESS COURIER INTERNATIONAL DELIVERY (ECI)
Due to the increasing unreliability of postal services in many parts of the world, delivered full building plans are sent by Express Courier International  service, where the purchase price of the plan is equal to or greater than $1000.00 AUD. Delivery cost is included in the plan price.

Due to the high cost of sending plans by courier, smaller plans with a  plan price of less than $1000.00 AUD are normally sent by International Air Mail. Should any plan be lost in transit it will be replaced. Builders may request that these plans be sent by Courier, however the cost of Courier delivery must be added to the plan price. The builder should contact us for a quote prior to purchase. 

Also due to the high cost of sending small items by Courier, standard study plans, data disks etc are sent by International Air Mail. Document portions of plans may also be sent by email upon request.

ECI deliveries must be made to a street address, and cannot be made to a P.O. Box or Mail service. They are tracked, and must be signed for on receipt. Where a client chooses to provide only a P.O. box or mail service, we will attempt to request a street address by email, or else the plans will be sent by standard airmail, at our discression.

Our Carrier of choice is the Australia Post Express Courier International Service. This service delivers to 99% of countries in the world. For countries which are not covered by this service we will use other means available at our discression, but reserve the right to refuse the sale or refund the client's purchase price if we are unable to guarantee the arrival of the plans.

PLANS PACKAGE CONTENTS

Delivered plans are delivered in protective document tubes or packaging.

All plan drawing sheets are printed on Bond Paper in A1 format.

Plans which do not include electronic files (DXF or DWG) for mould or bulkhead cutting will include documentation (specifications, building manual, materials list etc.) printed on A4 paper.

Plans which include electronic files (DFX or DWR) for mould or bulkhead cutting will have those files supplied on a USB data stick, which may be supplied by you to your chosen laser or router cutting service. Plan documentation (specifications, building manual,materials list etc) for these plans will be included on the data stick in PDF format, and may be printed out on any home printer. Printed A4 copies of documentation will be supplied additionally at the builders request.

Receipts / Invoices will be provided for all purchases. For PayPal purchases, the receipt will be provided by PayPal electronically at the time of purchase. The receipt will generally be included with the plans for full stock plans and standard study plans ordered direct from this office, or will be sent seperately upon request.

Sales of study plans and study eplans are not refundable, as we charge only an average cost to cover printing and supplying these plans. 

We reserve the right to decline any sale of  full plans for any reason. In these cases, the clients payment will be refunded in full.

Where delivered plans do not turn up or arrive in a damaged condition, we are happy to arrange replacements. Refund of purchase price on full plans will be made where we are subsequently unable to guarantee successful delivery. 

Emailed / Downloaded Full ePlans are not refundable once a successful electronic copy of the plans has been received by or otherwise provided to the purchaser. 

We can not refund simply because you change your mind. Please choose your plans and your method of purchase carefully.

For reasons of client security we no longer accept credit card payments direct to this office. 

Our prefered method of purchase with credit or debit cards is via our PayPal Fascility, which ensures complete security for the purchaser and does not require your providing card details to us, the supplier.

All efforts are made by us to ensure that client information is maintained in a secure manner. 

We are unable to accept responsibility for security in transit where clients choose to provide information by publicly accessible means, such as mail, email, or telephone.

ADVERTISING PRIVACY

This site uses third party advertising companies to serve paid ads when you visit our web site. These companies may use information (not including your name, address, email address or telephone number) about your visits to this and other web sites in order to provide advertisements about goods and services of interest to you. For builders or prospective builders of a particular vessel , we are happy to provide contact details for other builders (where we possess such information, and those builders are willing to be identified), as we acknowledge the value of  liaison between builders. However we will provide only telephone numbers and email contact addresses. We will not provide street or postal addresses of clients.
